Terms of Service

Please read these Terms of Service (“Terms”) carefully before using OutReach. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use OutReach.

1. The Service

OutReach provides an AI-powered outbound email platform that allows you to connect your Gmail or Microsoft Outlook mailbox, build prospect lists, generate email sequences, and send campaigns from your own email account (“Service”).

OutReach is a business tool. It is intended for legitimate B2B sales and marketing outreach. Use of the Service for any other purpose is prohibited.

2. Eligibility and Accounts

You must be at least 18 years old and authorized to enter into a binding agreement on behalf of yourself or the organization you represent. By using OutReach, you represent that you meet these requirements.

You are responsible for maintaining the security of your account and for all activity that occurs under your account. Notify us immediately at support@outreach.io if you suspect unauthorized access.

3. Acceptable Use

You agree not to use OutReach to:

  • Send unsolicited bulk email (spam) that violates applicable law, including CAN-SPAM, CASL, or GDPR
  • Send emails to purchased, harvested, or scraped lists not obtained with proper consent
  • Impersonate any person or organization, or provide false sender information
  • Send content that is illegal, defamatory, harassing, threatening, or fraudulent
  • Probe, scan, or test the vulnerability of OutReach systems
  • Circumvent any technical limits, rate limits, or access controls
  • Use the Service in any way that damages OutReach's reputation or infrastructure
  • Resell or sublicense the Service without written permission

You are solely responsible for the content of emails sent through OutReach and for compliance with all applicable laws in the jurisdictions where you send emails, including but not limited to CAN-SPAM (US), CASL (Canada), GDPR (EU/UK), and similar regulations.

4. Email Sending Compliance

OutReach is built for cold outreach to business prospects. You are responsible for:

  • Ensuring you have a legitimate interest or consent basis for contacting prospects
  • Honoring opt-out and unsubscribe requests promptly (within 10 business days)
  • Including a valid physical address in commercial emails (required by CAN-SPAM)
  • Not sending emails with misleading subject lines or from addresses

OutReach provides unsubscribe link functionality. You must include unsubscribe links in all commercial emails and must not disable or circumvent this functionality.

5. Connected Mailboxes and Google / Microsoft APIs

When you connect a Gmail or Outlook mailbox, you authorize OutReach to use the Gmail API or Microsoft Graph API on your behalf within the scopes you grant. You remain responsible for the emails sent from your account. You can revoke this access at any time through your Google or Microsoft account settings.

You agree that your use of Google APIs through OutReach is also subject to Google's Terms of Service and the Google API Services User Data Policy.

6. Subscription and Payment

OutReach offers a free Starter plan and paid plans (Pro and Agency). Paid subscriptions are billed monthly or annually in advance. Prices are listed on our pricing page and may change with 30 days' notice.

Payments are processed by our third-party payment processor. We do not store full payment card details. Subscriptions renew automatically unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period.

Refunds are governed by our Refund Policy.

7. Intellectual Property

OutReach and its content (excluding your data) are owned by or licensed to us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

You retain ownership of all data you upload to OutReach (prospect lists, email content, etc.). You grant us a limited license to use this data solely to provide the Service.

8. AI-Generated Content

OutReach uses AI to generate email sequences, reply classifications, and optimization suggestions. AI-generated content is provided “as is” for your review and editing. You are responsible for reviewing all AI-generated content before sending. We make no warranty that AI-generated content is accurate, complete, or appropriate for your use case.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, upgrades, or emergency fixes that temporarily affect availability. We will provide advance notice of planned downtime where reasonably possible.

10. Termination

You may delete your account at any time. We may suspend or terminate your account immediately if you violate these Terms, engage in abusive behavior, or if required by law. Upon termination, your right to use the Service ceases. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, that emails sent through the Service will be delivered, or that deliverability rates will meet any particular threshold.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTREACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless OutReach and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or the emails you send through the Service.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which OutReach is incorporated, without regard to conflict of law principles. Disputes shall be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction there.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
